September 30:  At La Pointe, Wisconsin, the American Government entered into Treaty with the Chippewa (Ojibwa) of Lake Superior, of Mississippi, of Pillager, of Red Lake (see our NADEAU) and of Pembina.  The Chippewa of Lake Superior numbered four thousand and was represented by the following bands:
        La Pointe, Wisconsin near Bayfield
        Ontonagon, Michigan
        L'Anse, Michigan
        Viex de Sert
        Grande Portage, Minnesota
        Fond du Lac (Cloquet), Minnesota
        Lac Court Oreille, Wisconsin
        Lac du Flambeau, Wisconsin
        Bois Fort

This treaty also applied to Mixed Blood Chippewa as follows: Each head of family or single person over twenty one years of age at September 30, 1854 was entitled to eighty acres of land according to the Secretary of the Interior as recorded on April 21, 1871 and printed on 1874.  The treaty interpretation included married women, widowed women and persons under twenty one who are raising a family. Louis Garneau and some of his family qualified for land script and appear under the family name of Gurnoe. Lawrence Garneau would be fourteen years of age and therefore not entitled to Mixed Blood script.  This probably accounts for his migration life style when most of the Lake Superior peoples settled into a more sedentary life style. (NOTE: Many people were added later.)

General Luther E. Webb, Indian Agent for the Lake Superior Chippewa and Mixed Blood Chippewa (Ojibwa), issued script or certificate for script to the following Mixed Blood Chippewa at Sault Ste Marie, as witnessed by James Chapman and Joseph Gurnoe:

Jean Baptiste Perrault (Perrot) II: (1763 - 1844)

He was the son of Jean Bte.Perrot (Perrault) I & Marie Lemaitre, born at Trois-Rivieres, Quebec. His father belonged to a very respectable Canadian family and was employed in the time of the French, in a forge at Saint-Maurice, then at Trois-Rivi?res, when the country became an English Colony. Later, he was trading at Rivi?re-du-Loup. Jean II departed, in 1783, in order to trade on the Illinois on the behalf of Nicolas Marchesseau, an important trader at this time on the Upper Mississippi. His companions on this journey were Canadians: Sacharit? of Quebec; St.Germain, Robert & Dupuis of Maskinong?; Antoine & Francois Beauchemin, M?nard, L.Lavall?e of Sorel & Yamaska . Marchesseau sold all his goods in the trade to Chouteau, of St-Louis.

The following is his narrative of a trade expedition he was on led by Alexander Kay to the height of land separating the Mississippi & the Great Lakes drainage basins, west of the headwaters of Lake Superior, in 1784-85, published in the "Michigan Pioneer and Historical Collections" in 1909:

"...Upon entering the river the next day and doubling the point of the little lake, we saw a wintering-house. It was that of Mr. Dufaut, come from Grand Portage, clerk for NW. and we stopped before his door. As Mr.Kay had perhaps taken only one drink he now took the second which made him ill-tempered so that instead of receiving politely Mr. Dufaut, who came down to meet him on the beach, he treated him rudely...  (Note: Can this be Therese's Father???)

The character of Mr.Kay was eccentric a man proud, impulsive, arrogant, enthusiastic, - taking counsel from no one, - in short, hare-brained...We started at all hazards to go into the interior with only what we had left...His party was composed of 14 men, his sauvagesse, himself, and me...To crown our misfortune we now met Mr.Harris with his three men and a savage named le Grosse Martre...I advised him to remain at Fond du Lac and to go up to the savages at the first opening of navigation, when they would be rich...Mr.Kay and Mr.Harris with seven men set out in advance to engage the savages to hunt...the savage arrived with a letter from Mr.Kay, informing me that he had decided to go to the Riviere aux Pins, and that he would send me some hunters. He directed me to try to advance to the Portage de la Prairie if possible and to pass the winter there...It took us eleven days to go from there to Portage de la Prairie amidst snow and ice, with nothing to eat. We lived on the seed-pods of the wild rose and the sap of trees...I made a lodge with an oilcloth near the small Lac de la Puise on the portage...the 26th of January and the 27th I went out with my man, whose name was Lauzon, to cut logs to build a house, 12 feet long by 10 feet wide. It was finished the 9th of February...We left the house about the 25th of April, for the little rivers opened early there...The water was very high and we could run the Portage des Pins, which we did. Mr.Kay wished to do as much, but about half way down the rapid, the canoe turned completely over destroying his baggage and he himself would have drowned, if le Petit Mort, his friend, had not leaped in to his rescue...The next day we arrived at Lac des Sables and reached the entrance near la Puisse...le Bras Casse, chief of Lac des Sables was at the lower end of a bay with some of his men making canoes...We remained there from the 27th day of that month till the 2nd of May to trade with the savages, who came in form all sides...The savages gave me the name of scribe, which they were accustomed to do to all whom the observed writing. As soon as Mr.Kay was gone I did not want for visits; Mr.Kay's savage woman staid in the tent with me. A great may savages came, among whom were, Katawabitais and Mang-Ozeit, who said to me, Scribe, give us some rum. I said to them that I could not, that I was not master. They tormented me a long time...Le Bariqueaeu appeared, who said that Mr.Harris and Mr.Pineau were about to arrive. Sure enough they appeared at le Puisse; the savages, all drunk, uttered cries of joy...they themselves were drunk from the flagon which Mr.Kay had carried with him...The festival was complete..."
Until 1789 he traded on the Chippewa, Minnesota, Crow Wing & Mississippi Rivers and from 1789 to 1803 an employee of the Fond du Lac Dept. He retired from the fur trade in 1821 and died at Sault Ste.Marie in 1844.

    I am stuck on Joseph Martel born 1825 somewhere in Canada. He married
    Genevieve Dufault June 5, 1843 at Mackinac. I am descended from their son
    Abraham, born 1845. Genevieve's father was Francis Dufault according to the
    1836 halfbrd census. No mother is mentioned. She was from the same area.
    The Martels do not appear on any of the Indian records with the exception of
    Genevieve who went by Jane. She recieved from the 1855 treaty. They lived
    in Detour of the UP of Michigan. He died Aug 22, 1908 in Moran Twp. Thats
    about the extent of it. Thanks for any leads, Terry


    ANOTHER VERSION OF CLUE from GURNOE HISTORY

    (VI)-Louis Garneau also Gournon, Gornow, Gurnoe and Gaunaux is born 1790, Wisconsin, most likely La Pointe, Madeline Island, Lake Superior died October 21, 1863 Sault Ste Marie, Michigan.  He is of 50% Mixed Blood being the son of Monsieur Garneau or (V)-Jean Baptiste Garneau born 1762 and Se Gaunaux (So-Way-Guay) as per 1854 treaty script No. 31C.  Theresa Schenck suggests the Sault Ste Marie records list his death as October 21, 1863 age 74.  Court records of July 5, 1890 suggests his death is 1865.  The father of Louis has not been verified and the quest continues.

    Married about 1815 at La Pointe, Wisconsin to a Say-shaw-ne-nie  born 1800 Canada daughter Se Ranze of La Pointe and she is still unable to read or write in 1850. Louis is living Sault Ste Marie in 1854.  (also see 1809)

    SOURCE: Treaty with Chippewa of Lake Superior, September 30, 1854.  The treaty listed each head of family, single or widowed person, over twenty one years of age (in 1854) or who is raising a family.   They must be of mixed blood and then become entitled to eighty acres of land.  The listing issued by the Secretary of the Interior, April 21, 1871 as published by Government printing office 1874.  Listing of 1850 census Sault Ste Marie, Michigan reference #12-12 records some of the younger children.   Red Cliff Reservation, Bayfield Bureau of Indian Affairs records, Carole S. Fizell Cadotte Gordon of Ashland records and County Court records.  The list of selection of land made by the Ottawa and Chippewa Indians of Michigan, under treaty of July 31, 1855, included Louis, Say-Shaw-Ne-Nie and So-Way-Guay.  Listing of Sault Ste Marie bands of Ottawa and Chippewa Indians including John Gurnoe, Eli (Elisha) Gurnoe and Francois Gurnoe.  1840 census of Stephen R Wood county lists Louis Gornow with eight boys and five girls living at home.

    Louis had a second marriage about 1824-28 at Sault Ste Marie, Michigan to a (V)-Archange Cadotte listed in 1854 treaty script No 40 living 1854 Sault Ste Marie, Michigan alias Julia Nolan (Nolin) script No. 119 according to the testimony of  Joseph Gurnoe, in 1870.  (family members are also recorded as Guernon, Gurnoe, Gournoe, Gournon, Gournow, Gornow, Genereau and Generareaur). The name spelling of Gurnoe, Gurno and Gurneau are the most common surviving spellings in Lake Superior and Red Lake areas

    Spelling of family name as Gurnoe is by Joseph Gurnoe who assisted all applicants for script application of Mixed Blood Chippewa of Lake Superior.  He identified family members.  He also assisted in Full Blood Indian allotments before 1854.

    A List of the Mixed-Blood Chippewa of Lake Superior, 1839

    When the Lake Superior Chippewa bands agreed to the treaty of 29 July 1837 at St. Peters, article three of that treaty allowed the sum of $100,000 to be distributed to the “half-breeds” of the bands participating in the treaty, to be done under the direction of the president. As was customary at the time, the president appointed a commissioner, Lucius Lyon, to take testimony and produce a roll of claimants. Lyon traveled to Lapointe on Madeleine Island in Lake Superior in the fall of 1839, took testimony from those who believed themselves entitled to share in the money and prepared a roll which was submitted to the chiefs who in council made the final decisions on who was to receive the payment. The roll was submitted by Henry R. Schoolcraft who was acting disbursing agent for the Michigan Superintendency, and is not part of his file in the Indian Accounts of the 2nd Auditor, Records of the General Accounting Office (RG 217) at the National Archives Records Center, Suitland, Maryland.

    The roll lists 880 claimants to the money, all of whom presumably believed themselves to be mixed-blood Chippewa. The roll provided the name of the claimant (usually the husband or father), the names of those in whose right the claim was made (i.e. the actual mixed bloods), the fraction of Chippewa blood, the residence and birthplace of each person and whether the claim was accepted or rejected. In total, the roll provided a sort of census of a substantial portion of the white and part-white population of the western Lake Superior area. Like any census though the information must be used with caution. While deliberate intent to deceive the authorities has not been detected, there are likely to be errors or misinterpretations, compounded by the difficulties of mixed cultures and languages. For example the ½ fraction in some cases may not be exactly accurate, but rather a numerical notation of the term “half-breed”, which was often used in a general sense to mean anyone of mixed ancestry (in this area usually Indian-White).

    The criteria for acceptance by the chiefs seem to have been similar to those of the Ottawa and Chippewa treaty of 28 Mar. 1836. The mixed-blood payment roll for that treaty lists the reasons for rejection. The two most common were “residing outside the area ceded by the treaty” and not being related to the particular bands participating in the treaty. The researcher must be very careful about making genealogical inferences based on rejection or admission.

    The DuFault persons listed here are from an Alphabetical Register of the men, women and children of the half breed Chippewas of Lake Superior claiming under the third article of the treaty made with the Chippewa Nation of Indians… submitted to, and ratified by the chiefs on the Chippewa nation, parties to the treaty above mentioned in open council on the 7th day of September 1839.

    "Michelle (Michael) Dufault, one of the oldest residents of the White Earth Reservation, died at the home of his daughter, Mrs. Antoine Charrette, December 14, 1916, aged ninety years. He was the son of Joseph Dufault, one of the early artisans of the Northwest, and of Jossette Cadotte, an aunt of William Whipple Warren, the well-known historian of the Chippewa Indians. His father was for many years a boss carpenter; between the 1820 and 1830 he supervised the construction of the stores and warehouses of the American Fur Company on Madeleine Island in Lake Superior, eighteen miles from Bayfield, Wisconsin. He built the mission churches on the island also, one of which, the Presbyterian church, is still standing. The Catholic mission church, which contained a rich and valuable collection of historical manuscripts and old paintings, was destroyed by fire about three years ago.

    Michael, the son, was born in 1827 on Madeline Island, at that time included in the territory of Michigan. In his boyhood he attended the Indian mission school. During his early life he helped his father by working at the carpenter's trade and assisted he fur-traders as clerk, interpreter, and messenger. He was a member of the Wisconsin bands of the Chippewa, but removed to White Earth Reservation many years ago. where he was held in high esteem by all who knew him. He was married to Jossette Roy, a daughter of Vincent Roy, an early Indian trader, who died in Superior, Wisconsin, a few years ago.

    In the death of Michael Dufault the Northwest loses one of the few remaining picturesque "noble landmarks" so characteristic of the unstinted, open-hearted hospitality and generous chivalry of early northwestern days, the cherished love-thy-neighbor days, when the latchstring hung on the outside, suggestive of and ever-ready welcome to friends and strangers alike; when the last morsel of food or family rainment was cheerfully divided with those who were in need, and when a man's word was his bond. He was an exemplary Christian, devoted to his family and friend and to things righteous. He was a member of the Catholic Church and was ever zealous in his religious duties up to the time of his death."
